SHIPPING POLICY

This Shipping Policy outlines the shipping and delivery process upon purchasing products from suppliers through the NOM170 website. NOM170 may change this Shipping Policy from time to time. If NOM170 makes changes to this Shipping Policy, we will notify you by revising the date at the top of this page and, in some cases, may provide additional notice (such as sending you an email). NOM170 encourages you to review this Shipping Policy prior to purchasing products to stay informed about shipping requirements and delivery information. Unless otherwise defined here, terms used in this Shipping Policy have the same meanings as in NOM170’s Terms of Use.


1. LEGAL NOTICE

Products are sold within the state or jurisdiction where the supplier is located, and title to the product(s) passes to the buyer once the product is delivered to a common carrier in the supplier’s jurisdiction. By placing an order with a supplier via the NOM170 website, you authorize the supplier to have the product(s) shipped on your behalf by common carrier for delivery to your selected destination. Under the terms of sale, the common carrier is acting as your agent.

You may wish to insure your shipment, as NOM170 does not provide such insurance and has no control over the supplier’s products or delivery thereof. NOM170 urges all buyers to investigate the laws in their respective states regarding the shipment of alcohol before placing any order on the NOM170 platform.


2. ORDER PROCESSING

Once you have placed an order for product(s) through the website, you will be notified that your order has been received. You will then be notified within forty-eight (48) hours whether:

  1. The supplier has accepted your offer to purchase and will ship the requested product(s);

  2. The supplier has accepted your offer to purchase, but the product(s) is delayed or on backorder; or

  3. Due to supplier complications, your offer to purchase has been rejected.

Any credit card payments will not be processed if you are notified that the supplier has rejected your offer.

If the product(s) you ordered are in stock, the supplier will use its best efforts to ship such product(s) within 3–5 business days of notification. Tracking numbers are sent to you by email from UPS or FedEx.

3. AGE VERIFICATION

The website and services are intended for use by persons 21 years of age or older. Persons under 21 are prohibited from using the website or services in any way. By placing an order via the website, you represent that you are at least 21 years of age. NOM170 reserves the right to ask for proof of identity before allowing access to the website or permitting any purchase.

At the time of delivery, you and/or the recipient must sign an age verification receipt stating that they are at least 21 years of age and must present a valid driver’s license, military ID, passport, or state ID. All shipments must be signed for.

According to UPS policy, if no individual at least 21 years of age is present to sign for the package after three (3) delivery attempts, the package will be returned to the shipper. The package can be reshipped with a $24.99 reshipping fee.


4. STATES

It is NOM170’s policy not to assist suppliers in shipping to states where direct shipment of alcohol products is prohibited. Therefore, the website will only allow you to place orders for shipment to eligible states.


5. DELIVERY CHARGES

All deliveries are made by ground transportation through UPS. Delivery charges may vary depending on the size, weight, and destination of the shipment. NOM170 is unable to deliver to PO Boxes.

We will use our best efforts to notify you of any shipment delays due to weather or other conditions. Please direct all shipping questions to support@seelbachs.com.

Three delivery attempts will be made. If no adult is available to sign for the package, it will be returned to NOM170. A $24.99 reshipment fee will apply if you choose to have the items reshipped.


6. DAMAGED PRODUCTS DISCLAIMER

You agree that NOM170 is not responsible for any product damage that occurs during shipping. If any product(s) are damaged during transit, please email support@seelbachs.com so we may pursue a claim with the shipping carrier. Shipping charges are non-refundable.

NOM170 strongly urges you to consider weather conditions before ordering. Heat exposure during warm months or extreme cold during winter may damage products during shipment. If you would like your order held until temperature conditions improve, NOM170 will accommodate this at no additional cost.


7. SPECIAL SHIPPING TAXATION

Certain states require the collection of sales tax on all orders containing alcohol products. Such tax rates vary between states and will be added to your purchase price. You will be informed of applicable taxes prior to payment.


8. DELIVERY OF PRODUCTS

Delivery can only be made to an address where an individual at least 21 years old is available to sign during regular business hours. Products can be shipped to a place of business or residence. Purchaser and recipient must both be over 21 years of age.

Warning: Certain states expressly prohibit the direct importation of alcohol. Violations may be punishable as misdemeanors or felonies. Please contact your local alcoholic beverage control agency for further information. Some states also limit the quantity and type of alcohol that may be shipped to an individual address.

NOM170 and its affiliates make no claims regarding your rights to receive shipments into your state or jurisdiction. If you are uncertain, please contact your local governing bureau or agency before ordering. Void where prohibited by law.
